Kymberly Porter’s Motion to Dismiss Affirmed by the Supreme Court of Alabama

Congratulations to Kymberly Porter for her Motion to Dismiss being affirmed by the Supreme Court of Alabama.

On September 8th, 2022, Michael Mills was traveling on I-75 South in Bradley County near Chattanooga, Tennessee, when he collided with another vehicle. The plaintiff, Noelia Harmon, alleged the accident left her with pain and mental anguish.

Kymberly argued that the Tuscaloosa Court lacked both personal jurisdiction and subject matter jurisdiction over the Defendant, Michael Mills. The only connection Defendant had with the state of Alabama was a driver’s license he possessed at the time of the accident. Both parties were residents of Tennessee and the accident occurred in the state of Tennessee. The trial court granted Defendant’s Motion for Summary Judgment and the Plaintiff appealed. On appeal, the Supreme Court of Alabama affirmed the trial court’s ruling, dismissing the case.
